1. General Terms and Conditions

1. General. These General Promotion Rules ("Rules") apply to any promotions that may be provided, from time to time, by Fortune Mine Oyun Yazılım A.Ş. ("Fortune Mine", "Fortune Mine Corp." or "us"), through our website(s), game(s) and/or applications (collectively, the "Services") (the "Promotion"). Each Promotion is organized by Fortune Mine which owns and operates the Services, or any third party on its behalf. Each Promotion is also regulated by Fortune Mine Terms and Conditions located at the link of [] ("Terms and Conditions").
2. NO PURCHASE IS NECESSARY IN ORDER TO PARTICIPATE IN ANY PROMOTION. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
3. PROMOTION IS VOID WHERE PROHIBITED BY LAW.
4. FORTUNE MINE DOES NOT UNDERTAKE OR GUARANTEE THAT THERE WILL BE A PROMOTION. AT THE SOLE DISCRETION OF FORTUNE MINE, NO PROMOTION MAY EXIST.
5. Compliance. You agree that in order to participate in any Promotion (including, without limitation, in order to win any reward), you will fully comply with all applicable laws, regulations, statutes, ordinances and provisions that apply to you and to us, including, without limitation, these Rules, the Terms and Conditions and Special Terms (to the extent published) and any terms and conditions published by any platform through which you are using the Services (collectively, "Fortune Mine’s Terms").
6. Collection of Information. Any collection and processing of personal information as part of or in connection with participating in any Promotion is subject to and governed by our Privacy Policy and PDP Clarification Text. Participants accept and declare that they have read the Privacy Policy in addition to these Rules and that their personal data shared within the scope of the Promotion, will be processed by Fortune Mine as the data controller.
7. User’s Representations and Obligations. In order to participate in any Promotion, each user ("User" or "you") hereby represents and warrants that he/she has full right and authority to participate, has read and agrees to be unconditionally bound by these Rules; the Terms and Conditions, any terms and conditions which may be applicable if the user participates in any Promotion through any third party platform, and any special terms and conditions relevant to any certain one or more Promotion as may be displayed on the Services, from time to time which shall be published by us with respect to such specific Promotion(s) ("Special Terms"). In case of any inconsistency between any Special Terms and these Rules, the Special Terms will prevail.

2. Sponsor of the Promotions

We will conduct the Promotions substantially as specified in these Rules (as shall be in effect from time to time), unless otherwise will be specifically specified with respect to any Promotion, in which case the specific provisions will apply.

3. Eligibility for Participation in Promotions

1. Eligibility. In order to take part in a Promotion you must (a) be at least 18 years old (unless the applicable age of majority in your state of residence at the time of the entry is higher) (b) be eligible under applicable law to participate in the Promotion, and (c) comply with any specific Special Terms applying to such Promotion (in addition to these Rules, the Terms and Conditions and any applicable laws, regulations and obligations that will apply to you and your use of the Services). Without derogating from the foregoing to the contrary, any specific Promotion may be allowed only to Users located in a particular jurisdiction (or may be prohibited to Users located in certain jurisdictions), in which case only Users residing in the permitted jurisdiction(s) when they enter the Promotion can participate in such Promotion. Employees, officers and representatives of Fortune Mine and/or any promotion agencies, sponsors and reward suppliers (if any) which are directly involved in the administration, development, fulfillment and execution of a specific Promotion, as well as the immediate family (spouse, parents, siblings and children) are not eligible to participate in any relevant Promotion, unless otherwise will be permitted by us, from time to time, and solely to the extent that such permission is in accordance with any and all applicable laws.
2. Proof of Eligibility. You may be asked at any time to provide us or our designated third party with proof of your age and/or identity and/or residency and you must, on demand, be able to present a valid documentation which may enable us to verify your age, residency and/or identity to the reasonable satisfaction of our security team. If you are unable to provide satisfactory documents, we may exclude you from the applicable Promotion and may forfeit any privileges or awards that have been allocated to you without compensation of any kind. You hereby irrevocably waive any claims or rights in connection with any such exclusion and/or forfeiture.

4. How to Participate in Promotions

1. Entering a Promotion. During the period of any specific Promotion, you can enter the Promotion by using the Services and follow the links and instructions for entering the Promotion. We may, from time to time, limit the period of each Promotion, in which case, we may publish the applicable period as part of the description of the Promotion. Please note that the use of the Services, which can be downloaded free of charge, requires an internet connection and a compatible device. You must enter the Promotion during the period of the relevant Promotion to be eligible for winning the reward applicable to such Promotion. Our and/or our affiliates’ systems will be used for determining when the period of a certain Promotion has commenced or concluded.
2. Free Participation. You may also participate in the Promotion without making a purchase by sending an e-mail in English to [email protected] within the period of the applicable Promotion. The subject of the e-mail will be FREE PARTICIPATION REQUEST and the name of the relevant Promotion. The e-mail must contain the User’s full name, address, phone number, email address, year of birth and the Promotion in which such User wishes to participate, provided that such valid e-mail is received by us during the applicable period of the relevant Promotion. Subject to the terms of these Rules, each valid e-mail received by us during such period will entitle you to receive one entry into the applicable Promotion. Any requests for participation which do not comply with the foregoing may be disqualified or void at our sole discretion and any other form or method for submitting an entry are not valid and may be disqualified.
3. Our Property. All participation requests are our exclusive property and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by us and our records that any e-mail was received or not will be binding on the parties and you will have no claims against us for any requests which were not received by us, for any reason whatsoever, or which were received before or after the period of the applicable Promotion. Each e-mail address may only refer to one entry into a certain Promotion.
4. Number of Entries. Unless otherwise is specifically allowed with respect to any Promotion, you may not use multiple e-mail addresses, accounts or identities or any other method in order to participate more than once. Any use of automated system or any similar method to participate in any Promotion is strictly prohibited and may result in your disqualification. The person to whom the e-mail address was assigned by the applicable operator shall be deemed as the owner of such e-mail address. We may also disqualify, at our sole discretion, any User from any Promotion if he/she has purchased in-game items or currency (if applicable) through another player or other means that are not in compliance with the Terms and Conditions and these Rules.
5. Disqualification of Users. If we become aware of any fraud, deceit, misconduct, dishonesty or similar action concerning your participation in the Promotion, or if you acted in a disruptive manner or with the intent to disrupt or undermine the legitimate operation of any Promotion or if you breached any of these Rules, the Terms and Conditions and/or the Special Terms and/or any additional laws, regulations and rules which apply to your use of the Services and/or your participation in any Promotion, then (i) we reserve the absolute right to automatically and immediately disqualify you or invalidate your entry, and (ii) we also reserve the right to seek damages and other remedies from you to the full extent permitted by law. If the fraud, deceit, misconduct, dishonesty or other action is only discovered after any applicable reward has been granted to you, then you shall be required, upon demand, to return the same (or provide compensation) to us immediately upon the delivery of our demand to do so.
6. Continuity of a Promotion: We may decide, at any time and at our sole discretion, to cancel, delay or postpone any specific Promotion.

5. Rewards and Winners

1. How to Win a Reward. The manner in which winners are selected may vary regarding each Promotion, and may be detailed, from time to time, in any Special Terms applicable to each Promotion or as otherwise posted via our Services. Our decisions regarding the administration and operation of the Promotions, including, without limitation, the selection of potential winners from all eligible participants are final and binding in all matters related to the Promotion. Rewards will vary from one Promotion to another and will be indicated in the Special Terms applicable to each Promotion.
2. Odds. Odds of winning a reward may vary from one Promotion to another and may depend, among others, on the number of eligible users participating in each Promotion. With respect to any sweepstakes, the odds of winning depend upon the number of valid entries received by us or as otherwise shall be specified in any Special Terms applicable to each Promotion.
3. Rewards. Unless otherwise will be specifically specified regarding any specific Promotion, rewards are digital in nature and have only entertainment value within the Services, have no "real world" value and can only be used within the Services and cannot be cashed out or tradeable. Rewards may not be transferred or substituted except as provided herein at our sole discretion. If a reward, or any portion thereof, cannot be granted for any reason, we reserve the right (but not the obligation) to substitute such reward (or a component thereof) for one of equal or greater value. If, notwithstanding the foregoing to the contrary, any specific reward will have actual "real world" value, such value will be specified in the Special Terms of the relevant Promotion and in any event, you are not allowed to transfer or substitute any reward, unless we will specifically approve so, in our sole discretion.
4. Disclaimer. All rewards that may be granted as part of any Promotion are offered "AS IS" without any warranty, either expressly or in an implied fashion, by us or by any third party. Screen shots shall not be deemed as proof of winning status. The Promotion or any part thereof are in no way organized, endorsed or administered by, or associated with, any social network or application store.
5. Taxes. If notwithstanding the foregoing to the contrary, we will publish, with respect to any specific Promotion, that any reward has a cash value, then the winner will be responsible for paying all costs and expenses relating to such reward that are not specifically mentioned, including, without limitation, any and all applicable taxes.
6. Number of Winners. The number of winners that will receive an award in each Promotion may defer, from one Promotion to another, and may be specified in any Special Terms applicable to a Promotion. To the extent that the number of winners is limited and one or more of the winners is/are disqualified for any reason, the relevant reward may not be granted, unless otherwise will be resolved by us, in our sole discretion.
7. Collection of Rewards by Users. If you win a reward and do not accept and collect it within seven (7) days since the initial date on which we notified you of such reward, we may forfeit the reward and grant it to an alternate winner. Notwithstanding anything herein to the contrary, no reward will be granted to any User who, for any reason, would not be allowed by applicable law to receive and/or use such reward or where the supply of the reward to that User would be unlawful or in breach of the terms of these Rules.
8. Users’ Consent. Unless legally prohibited in the relevant jurisdiction, participation in any Promotion constitutes each User’s consent that we and/or our agents post or use, in case that he/she wins any Promotion, his/her name, photograph, likeness and/or hometown, state or province for any purpose in any media, worldwide, without any additional payment or consideration, and for such purpose the winner will provide us, a perpetual, unlimited, non-exclusive, royalty free, right and license to use any or all of the foregoing in any manner as determined by us in our sole discretion.
9. Notification of Winning. We will notify each potential winner by sending a notification within the Services or as specified in any applicable Special Terms applicable to such Promotion or as specified in the Services, from time to time. If a potential winner cannot be contacted within 96 hours, or if such winner is otherwise disqualified or does not comply with these Rules, potential winner will be disqualified and forfeits the reward. It is your sole responsibility to notify us in writing if you changed your e-mail address during the Promotion period.
10. Disqualification of Winners. If any potential winner is required by any applicable law, these Rules and/or by the Special Terms of any applicable Promotion to comply with additional conditions or requirements in order to participate in the Promotion and receive the reward; such potential winner must fully comply with such requirements within the time set by us before and as a condition to receiving the reward. If a potential winner is disqualified for any reason, we may award the applicable reward to an alternate winner from among all remaining eligible participants or cancel the reward, in our sole discretion.

6. Limitation of Liability

We and/or any party related to us, directly or indirectly, including without limitation, any of our shareholders, directors, officers, affiliates, employees, consultants or agents and/or any platform through which you access the Services shall not be liable or responsible for any use of the Services by the Users, User’s participation in or attempt to participate in any Promotion or any such User’s ability or inability to upload or download any information in connection with the Promotion and you hereby irrevocably waive any claims, demands, damages and/or liabilities that you and/or anyone related to you may have against any of the foregoing in connection with any Promotion (including any reward), including, without limitation, in case that we may decide, at any time, to cancel, delay or postpone any specific Promotion. Without derogating from the foregoing, it is hereby agreed that under no circumstance will us and/or any of our shareholders, directors, officers, affiliates, employees, consultants or agent , at any time, be responsible for any failures or malfunctions of any kind, including, but not limited to, technical interruptions or disconnections in internet connection or network hardware or software, any incorrect or inaccurate information, undeliverable, late, damaged or stolen mail or any damage caused to persons or property which may be caused, directly or indirectly, in whole or in part, from User’s participation in the Promotion or receipt or use or misuse of any reward.

7. Amendment

We reserve the right, at any time, to alter these Rules, and/or the Special Terms at our sole discretion, including to cancel, modify or suspend any Promotion if, in our sole discretion, we believe that the Promotion is not capable of being conducted as specified. Any changes to any Promotion shall be displayed/published through our Services and your continued participation in that Promotion shall be deemed an acceptance of any proposed changes, modification or alterations. It is your responsibility to review these Rules from time to time.
